Personal injury law is a broad and complex legal field that can involve the negligent, reckless, or intentional acts of another. Sometimes these injuries are so severe and egregious that a death results. These wrongful deaths not only tragically end a person’s life, but also bring tremendous suffering to the decedent’s family, children and friends. A wrongful death is usually the result of a personal injury and can occur from a car accident, truck wreck, medical malpractice, or even a slip and fall. A wrongful death case may also result from accidents that occur from faulty products or premises.
Wrongful death cases concern the legal remedies available for the death of a person. These remedies include the rights and benefits of a surviving spouse, children, family members, friends and business partners. Each case is individual and might involve guardianships, child custody and support , as well as probate and estate administration .
Wrongful death cases are usually brought by the estate of the deceased person and filed by the administrator of the decedent’s estate. The estate administrator should open an estate for the deceased person and file a complaint for the wrongful death in a separate action. This separate action is for the damage caused by the wrongful death, but does not usually include the administration of the estate. While the wrongful death and estate involve a common legal issue about the proceeds of the civil lawsuit, the two areas of law are different. An estate should be opened when a person dies, however, a wrongful death lawsuit is only filed when a person dies because someone or thing caused the death.
